1. Acceptance of Terms

By accessing or using Intandem ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Intandem provides an AI-powered procurement intelligence platform that filters, scores, and analyzes government contract opportunities (such as those from SAM.gov, ESBD, and FPDS) based on user-provided business capabilities.

3. Account Registration and Responsibilities

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The Service provides role-based access, and you must not share your account access with unauthorized users.

4. Subscriptions, Trials, and Payments

• Free Trial: We may offer a free trial (e.g., 3 days). During the trial, usage may be subject to limits (such as a maximum number of opportunities viewed per day).
• Billing: Paid subscriptions are billed automatically via our payment processor, Stripe.
• Suspension: We reserve the right to suspend or restrict account access for non-payment or abuse of the Service.

5. Use of Third-Party Data and Artificial Intelligence (AI)

• Government Data Sources: The Service aggregates data from third-party public sources (e.g., SAM.gov, USASpending). We do not guarantee the accuracy, completeness, or timeliness of this public data. You acknowledge that Intandem is not liable for missed deadlines, cancelled solicitations, or inaccurate award data originating from these sources.
• AI Analysis: The Service utilizes artificial intelligence (e.g. custom models based on frontier Gemini models) to parse statements of work, generate abstracts, estimate ballpark contract values and provide relevance scoring. AI-generated analysis is provided for informational purposes only. You are solely responsible for independently verifying eligibility requirements, reading official solicitation documents, and deciding whether to bid on a contract.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Scrape, data-mine, or automatically extract data from our platform without express written permission.
• Attempt to bypass or manipulate our analytics tracking, rate limits, or billing mechanisms.

7. Intellectual Property and Data Ownership

You retain ownership of the specific capability summaries and profile data you provide to us. Intandem retains all rights, title, and interest in the platform, algorithms, AI processing workflows, aggregated analytics, and the Service itself.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Intandem expressly disclaims all warranties of any kind, whether express or implied. We do not guarantee that the use of our Service will result in winning any government contracts.

9. Limitation of Liability

To the maximum extent permitted by law, Intandem shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law provisions.
